Cherry Tree Case For Assignment

Post by Waterstone » Mon Sep 29, 2014 9:15 am

This is the assignment due on 10/1/14. If you already did it you don't have to re-do it.

This is the assignment:

George Washington Smith is the corporate head of Cherry Tree International. Its business is lumber mining and selling across the entire country. The Corporate Headquarters of Cherry Tree is located in Virginia Washington’s home. All trees are mined in the lush forests of Vermont. John Adams Jones is a Massachusetts’s resident. Adams is head of Veep Industries. Veep buys real estate , constructs home on the property and then sells them. Cherry Tree puts in a bid on a piece of land (Lot 1060) owned by Andrew Jackson Hernandez, a resident of Illinois. This transaction is conducted In Illinois. The land is a prime piece of forest land located in Vermont. Jackson agrees to the sale of the land to Cherry Tree. The same day Veep puts in a bid for the same piece of land (Lot 1060), planning to remove the trees and develop the piece of property for housing. Veep’s bid is accepted by Jackson. The acceptance took place in the state of Illinois. The undeveloped land is valued at $65,000.00 dollars, and that is the amount of both Cherry Tree’s and Veep’s bids. Both Cherry Tree and Veep both sue Jackson for enforcement of the contract they claim they have with him. Where will the trial to determine who owns the land (who has title) be held? Be sure to give your legal reasoning in your answer.
