In 1963 in response to the overwhelming use of hallucinogenic drugs in the hippie movement the U.S. Congress passes U.S.C. Section 298333. The terms of this legislation outlaws the growing and distribution of any non-prescription medications/drugs which are classified as being hallucinogenic. Oxycodone is one such medication/drug. Johnny Badseed is a grower of apples in Washington State. Badseed is also an amateur scientist. In 2013, his experiments produce an apple which is naturally grown but contains a large amount of Oxycodone as part of its composition. He grows and markets these special apples as “Bad to the Core” apples. Simultaneously with Badseed’s development, the state of Washington’s Legislature passed a law stating growers of any natural product, such as apples, are immune from being prosecuted for the growth/distribution of such product that contain any hallucinogenic substance. This law is Washington State Free Growers Law, Washington Assembly Bill 44443. “Bad to the Core Apples” start selling like “hotcakes.” The U.S. Attorney General’s office in Seattle brings a lawsuit to stop Badseed from selling his apples. Badseed uses as a defense Washington’s Assembly Bill Number 44443. What result?
