Wm. Sessions owns Sessions, a book supply house. Sessions buys classic books to re-sell to its customers. Sessions entire company is computer automated. By typing in the name of a book it is ordered, wrapped and mailed to the customer. Salvador Tillerson is a customer of Sessions and he orders 20 copies of the classic book, “1984” by G. Orwell. When the employee of Sessions receives this order he goes to the computer and types in “1984” the 20 copies of the book “1984” is then wrapped and mailed to Tillerson. What neither Sessions or Tillerson realized is that the books that were sent were not the “1984” by Orwell, but instead were 20 Almanac Books, entitled “1984”.
Tillerson wants to rescind the contract. Advise him if there is any legal principle that he can use to rescind the contract.
